So far, foreigners seriously ill present on French territory for over a year could apply for a residence permit in the absence of "effective access" to treatment in their country of origin. The Besson Bill, plans to return them to their country if a treatment is "available" regardless of its quality, quantity, cost, and other actual conditions of access to treatment.

February 8, following repeated warnings from doctors, researchers and public health experts, the Senate rejected that provision. Yet the government has chosen to reintroduce the National Assembly, and goes even further: this provision is now accompanied by an article explicitly allowing evictions of foreign patients. These provisions will be considered until March 9 at the National Assembly. AID is mobilized along with many partners, such as ODSE, ISSC, and FNARS UNIOPSS, and launched a petition.
