looks like "sparkles" is code for stock footage, all references to sparkles need to be deleted.

This ones got the p5 water mark on one of the videos....

The question is now should we all log in to youtube and collectively harrass them? and personally report the clips? Or do we let pond5 deal with this?

The fact that some of these clips have the watermark on them should trigger copyright infringement on the user account at youtube. Google must take action. However, only Pond5 can submit the claim. If you click on the little flag on any youtube video it allows you to file a copyright infringement notice to youtube.

Since the Pond5 watermark are contained in many of these vids... it would be best for Ponds 5 to take action. Perhaps make a list of all the vids and users on Youtube that do this and send one long notice to Google!

The fair use law in the USA is pretty wide open. Most anything can be used as "editorial" and even used inside other derivative works without violating copyright laws. Now removing watermarks is an admission of theft. If you do some searches for your name and video you will find dozens of web sites with P5 video. many of them link back to Pond5, others do not. The use of P5 and other sites videos is widely done throughout the world. Removing watermarks to resell or use commercial is just wrong.

Well for every thing of mine I have already contacted Youtube about since I'm the copyright holder. I also said on one of there pages I will be looking to prosecute. I also contacted there host and requested exact numbers of how many times my personal work has been downloaded. I also threatened them with legal action if the link is not removed right away, and if I'm not provided with the information I'm seeking. I provided proof the work is mine and told them they are not authorized to distribute my work in any way.
As far as anyone that wants to get on there and harass them personally , while I do find that fair in instances like this, I'm not going to because I'm looking at going through the legal channels to re coupe damages for stolen property...
