As a side note; FAA does not have jurisdiction over North America, just America.
As the popularity of those devices increases, along with the stupidity of many of their users, we will continue to see restrictions on their use. Which is really too bad, because they are a great tool and a heck of lot of fun. Here in Canada their are many reports of people flying close to major airports, or peeping into someone's apartment etc.

The thing about laws, even constitutional ones, is, that if the need arrises, they can be changed. If someone puts a drone through the engine of an A320 on final, things will change.

True. And the need for pilots to be sober, mature, trained, considerate, careful, meticulous, and responsible is huge. Just like "real" pilots. But ultimately prohibition of UAV will work about as well as that of drugs alcohol and firearms. We don't want it to be so that only criminals own and operate these things. If there is Law, it MUST be reasonable, or it is sham, and worse than useless.

Even though congress has ordered the FAA to come with rules governing UAV's 55 pounds and under they (FAA) still do not have authority nor the man power to enforce a no commercial use of UAV's. Even if they (FAA) meets the mandate set by congress in 2015 it still won't be effective until congress passes those rules into law. And we all know how long it take congress to do anything these days so it may be years before we need to worry about the FAA.
One thing we all need to do is fly no higher than 400' and even then that's to high. Look that the head of a straight pin and 400' your quadcopter is smaller than that. Sure you know it's up there but where up there.

Regarding the Law, and the FAA, I think there should be some sort of concerted, organized effort by pilot/operators to help shape the law, instead of having to change a bad bit of policy, it might be easier to make it make sense in the first place.
WE ARE THE LAW, we do not bend over and let the Law do unto us. But only if we are active, not passive.
And there is a lot of rampant hysteria - some not unfounded no doubt, but if not unchecked, will be most unhelpful to our cause. We can start by not calling them drones, as there is a certain stigma associated with that term.

If we are the law? Why does the EPA, IRS, BLM, etc. get to make punishing regulations as non elected authority? We are the law sounds good but the president makes law and breaks laws and nothing is done. Live your life day to day and try to go unnoticed is really all a person can do.
