Question about car plates and licensing

Hi, I am not sure about which type of license should be applied on clips with visible car plates. Should they be editorial or commercial? For example I have this clip on Pond5 and SS:



Both of them approved it as commercial, however if you pause the video I suppose you could read the license plates and perhaps manufacturer badges on cars that stop on the crossroad. I was making videos with obviously visible car brands editorial, however I'm going through my videos now and checking whether I should have made some stuff editorial which I didn't initially. Can you give some simple rule to determine whether the clips should be editorial or not? Does it matter if you have to pixel peep to see it or not? Thanks

Anyone who films outside deals with the editorial vs. commercial dilemma regularly, myself included. I think the key phrase to keep in mind is "clearly identifiable." Can a person clearly identify themselves or their property in the clip?

As a guideline, I would say that the person or object must be identifiable when the clip is played as intended. For example, suppose the clip you posted with your question appeared in a commercial or movie. Do you think any of the pedestrians or drivers in the clip could clearly identify themselves or their cars while watching the commercial or movie? Highly unlikely in this case.

My experience is that in SS anything that can be identified has to be editorial (plates, logo, brands, etc.). They, SS, also has a list of buildings that claim they have a copyright over their exterior "public" facade. Today in P5 the curator makes the decision. Faces is complex because in countires like Pakistan, image rights does not exist. Nice clip. Here in P5 my clips of Carnival cruise ships entering port where rejected. They could not be used as comercial nor as editorial. There is no list on what structures cannot be sold as either comercial nor editorial. Over the years I know that I cannot film for income purposes the Carnival Ships, the Hollywood mountain sign, The Gherkin building in London.
