I've noticed this 2 tiered system isn't affecting everyone/all clips.(Like Drivingfootages library). So it seems there must be a way to opt out?

The new agreement will only come into effect on August 22, 2024.
I don't think there will be no way to opt out but perhaps you will be able to choose which tier your videos will be in.
In any case and according to this new agreement article A i, Pond5 "will have sole discretion to adjust the price of any Content to (A) maximize your overall revenue performance, (B) align with our tiered pricing model, or (C) comply with our minimum pricing guidelines"
