But there is an emergency exit built into them, which says: if you know that there is some surveillance law in another country then you have to stop the data transfer. And what the advocate general has just said is: "there is not just this emergency exit and you kind of are able to exercise it. But the Irish data protection regulator must stop the data transfers if there is such a surveillance law in the U.S." So that is now explicitly set by the advocate general. If the court follows them - that would mean that Facebook's data transfers would have to be stopped rather immediately, when this judgement comes out." SCHREMS GESTICULATING WITH HANDS (SOUNDBITE) (English) AUSTRIAN LAWYER AND PRIVACY ACTIVIST, MAX SCHREMS, SAYING: "On the privacy shield it is interesting because it explicitly says that U.S. law is fine, that U.S. surveillance laws are compliant with EU law. And it is kind of a side note in this case, but what was interesting is that the advocate general also mentioned that he has serious concerns about it. But as he wasn't explicitly asked to assess the validity of it, he hasn't done so. This may be very different for the judges. The judges may now have it half way on the table and still take a look at it. Especially because the judges were asking loads of questions on the privacy shield during the hearing which the advocate general has not done. So it is not unlikely now that the privacy shield will also get some kind of assessment in the final judgement."
