Might Be Problems For Vimeo Contributors

A posting on an independent forum has uncovered a potential problem with Vimeo. If you post clips there they have in their terms of contract :

Vimeo wants you to post your videos. Unfortunately, the terms provide that:

By submitting your Submission . . . VIMEO shall be entitled to unrestricted use of any Submission for any purpose whatsoever, commercial or otherwise, without compensation to the submitter.

One site has deemed that a contributor posting to Vimeo, does not qualify for being an exclusive contributor for their site.


Have not posted links to off site forums out of respect.

I saw that post you're talking about.

I still see Vimeo and youtube as a good advertisment medium. Just make sure anything you upload has a watermark with your contact and copywrite info.

I'm more concerned about the contributors that put clips up at Vimeo and then submits them for sale to agencies, not being aware that they granted a royalty free license to Vimeo. How about if you intended that clip to be rights managed?

I still believe there is no free lunch in life, now we have "discovered" the price to play at the free site Vimeo.

For advertising Jake, I have gone down the referral link side. I also have my own website that gets good traffic, from links around the place.

I guess personally I wouldn't post a video to vimeo that I was also trying to sell. I have seen others that did.
You're very right, there is no free lunch.

Vimeo is also very limited on how many clips you can put on their site with the free "membership". I still see google video or youtube to be the best bet. Facebook backed off the ownership of everything on their site. Vimeo isn't big enough to worry about the outcry. Hey Marcus, why not Youtube or Google Video as links here as well as the Vimeo?

It's no surprise that some do not bother to read the TERMS AND CONDITIONS before they submit content to a site until after they've been SCREWED.

yeah but if you have a clip with your face in it, or a company logo (as the main subject) they still need a release form for commercial use. I don't remember giving them a model release. Stuff like this can be challenged.

BTW google video does the same thing Don.

ahh I just realized, watermark all the videos with a trademarked logo, the logo trademark shouldn't be superceded by a contract agreement, Duh.... Im not a lawyer but that should work right>?
