But can the filmer also be sued for offering "wrong" clips for sale? We don't know where the buyer is going to use the content for... Its their choice to use it or not right?

Maybe Tom or Marcus can answer that based on the RF contract that a buyer agrees to when they purchase a clip. Of course if there is a doubt P5 puts the editorial remark with the clip. Buyers should be aware of that. Editorial is almost free game.

Here is one of my recent ones. The ford emblem can be seen, so I think I am going to do editorial to cover my butt.

BTW, if a buyer has an agreement with a company (say Ford, for example) to use editorial footage for commercial purposes, they can license your editorial footage.

Anybody can sue anybody else, if you don't want to take a risks then just record in a studio or make your own CGI.

Personally I would argue that because I am not selling the clips directly and I don't know who the buyers are I can't advise them on how to use it. Some countries allow certain subjects others don't. If you break the laws in your state, country, whatever,,,, you are misusing my clip...In just the same way a serial killer misuses a kitchen knife, or a burgler misuses a crobar. You are breaking the law with something that you purchased anonymously.

If however I upload a clip that belongs to video copilot, then that would be harder to defend because I am implying I made it. Dont Do that BTW!!! Some people have done it.

Also Scott if I was in court because of that clip, I would argue that the police car and the concept of "crime" was the main subject, and the ford logo was irrelevent to that message. Therefore it is incidental.
